Why 'toeslagpartner' status sinks claims that should sail through
Here is where the Belastingdienst's automated recovery system becomes a silent killer.
If you apply for huurtoeslag, the system checks if you have a 'toeslagpartner'. Under Dutch law, if you live with a partner, you must apply together. Your combined income determines your allowance. Many internationals do not realize that a roommate, a subletter, or a partner they did not register at the municipality can trigger a toeslagpartner designation.
The automated system cross-references your BRP registration. If someone else is registered at your address, the Belastingdienst may flag them as your partner. Your claim gets silently rejected or adjusted, and you receive a letter in Dutch that you might not fully understand.
I have seen cases where two international students sharing a flat in Delft had their huurtoeslag frozen for months because the system assumed they were partners. They were not. But proving that to the Belastingdienst required navigating a maze of forms and waiting weeks for a human to review the file.
Box 3 savings and the huurdersverklaring trap
The 2026 reforms expanded eligibility. The maximum rent limit was removed, and age eligibility was broadened. But the system still checks your assets.
If you have savings above the Box 3 threshold, your huurtoeslag drops. For 2025 claims, the Belastingdienst looks at your assets as of January 1, 2025. Then there is the huurdersverklaring. Your landlord must provide a signed declaration confirming your rent details, including the base rent (kale huur) separate from service costs. As of 2026, only the kale huur counts toward your huurtoeslag calculation. If your landlord refuses to sign, or if your contract is vague about what is base rent versus utilities, your claim stalls. The Belastingdienst will not process it without this document.
In cities like Eindhoven and Groningen, where informal rental arrangements are common, I have seen dozens of internationals lose out because their landlord simply ignored the request for a huurdersverklaring.
What to do right now if you missed the deadline
If you were eligible for huurtoeslag in 2025 but missed the September 1st deadline, here is what you need to do immediately.
First, gather your documents. You need your rental contract showing the base rent, proof of BRP registration, income statements for 2025, and a Dutch or EU bank account IBAN. If you do not have a DigiD, apply for one now. It can take weeks, and you cannot apply without it.
Second, log into Mijn Toeslagen with your DigiD. Select huurtoeslag, enter your details, and submit. The decision typically takes about five weeks, but it can take longer if documents are missing.
Third, if you have already left the Netherlands, you can still claim. You were eligible during the year you lived and were registered there. You can apply for a DigiD from abroad or use an authorized representative.
Do not assume you are ineligible because your rent seemed too high. The 2026 reforms removed the maximum rent limit. Check your eligibility before writing it off.
