Acceptance of the terms

By accessing or using Moments AI, you agree to these Terms of Service. If you use the service on behalf of a company or other organization, you confirm that you have authority to bind that organization to these terms.

Eligibility and account registration

You must provide accurate information when creating an account and keep that information reasonably up to date. You are responsible for all activity that occurs under your account unless caused by our own breach of these terms or applicable law.

Account security

• Keep your login credentials, backup codes, and connected accounts secure and confidential.
• Notify us promptly if you suspect unauthorized access or another security incident affecting your account.
• Use the service only for lawful business or personal purposes and in compliance with applicable laws and third-party terms.

Acceptable use restrictions

You may not use Moments AI to abuse the service or to cause harm to others.

• Use the service for unlawful, fraudulent, defamatory, harassing, discriminatory, or otherwise harmful conduct.
• Interfere with or disrupt the security, integrity, or performance of the service or attempt to gain unauthorized access to systems or data.
• Reverse engineer, scrape, copy, or extract the service except where applicable law clearly permits it.
• Upload or transmit malware, malicious code, or content designed to damage systems, exfiltrate data, or degrade service availability.
• Use content, personal data, or third-party materials through the service without having the rights or permissions needed to do so.

AI output and user responsibility

Moments AI uses automated systems and AI models to generate content, summaries, drafts, notes, and recommendations. AI output may be inaccurate, incomplete, outdated, biased, misleading, or unsuitable for your specific circumstances.

You remain fully responsible for reviewing, verifying, and approving any output before you rely on it, share it, send it, publish it, file it, sign it, or act on it. This applies in particular to communications, contracts, compliance, financial decisions, legal matters, health-related matters, employment matters, and any other material decision.

Moments AI is a software tool and does not provide legal, financial, tax, medical, or other regulated professional advice. You should obtain qualified professional advice where needed.

Third-party services and integrations

The service may connect to or rely on third-party providers, websites, software, and data sources. Those third-party services are outside the control of Scheduled B.V. and may have their own terms, privacy policies, availability limits, and security practices.

We are not responsible for third-party services, third-party content, or actions you take through integrations, except to the extent liability cannot be excluded under applicable law.

Paid features, subscriptions, and credits

Some features of Moments AI may require payment, a subscription, or usage-based credits. If you purchase paid features, you agree to the pricing and billing terms presented to you at the time of purchase.

Unless mandatory law requires otherwise, fees that have already been paid are non-refundable. You remain responsible for charges resulting from your use of the service, including usage generated through your account or authorized integrations.

Availability and changes to the service

We may update, improve, suspend, or discontinue all or part of the service from time to time. To the maximum extent permitted by law, Moments AI is provided on an "as is" and "as available" basis without guarantees that the service will be uninterrupted, error-free, or suitable for every use case.

Limitation of liability

To the maximum extent permitted by law, Scheduled B.V. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, goodwill, data, or business opportunities arising out of or related to Moments AI.

To the maximum extent permitted by law, the total aggregate liability of Scheduled B.V. for all claims arising out of or relating to the service will not exceed the greater of the amount you paid to us for the service during the twelve months before the event giving rise to the claim or EUR 100.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer protections.

Suspension and termination

We may suspend or terminate access to the service if we reasonably believe you breached these terms, created a security or legal risk, failed to pay applicable fees, or if suspension is necessary to protect the service, other users, or third parties.

You may stop using the service at any time. Provisions that by their nature should survive termination, including payment, liability, dispute, and intellectual property provisions, will continue to apply.

Governing law and disputes

These terms are governed by the laws of the Netherlands, excluding conflict of law principles. The competent courts in the Netherlands will have jurisdiction over disputes arising from or related to these terms or the service, unless mandatory law requires otherwise.

Changes to these terms

We may update these Terms of Service from time to time. If we make a material change, we may notify you through the service or by other reasonable means. Continued use of Moments AI after the updated terms take effect means you accept the updated terms, subject to any rights you may have under applicable law.
